Acknowledgment of Risk: I fully acknowledge, understand, and assume all risks, known and unknown, inherent or otherwise, associated with my Child(ren)’s participation in activities or use of the play floor, equipment, furniture, and facilities, including, without limitation, risks of bodily injury, property damage, disability, illness, or death. I understand that such risks may arise from the negligence, gross negligence, or other acts or omissions of Tiny Beans Play Cafe, its owners, employees, agents, volunteers, or other participants.
Voluntary Participation: I certify that my Child(ren) is/are voluntarily participating and that I, as parent or legal guardian, am voluntarily allowing their participation. I acknowledge that supervision of my Child(ren) at all times while on the premises is my sole responsibility.
Comprehensive Release of Liability: On behalf of myself, my Child(ren), and any other legal representatives, heirs, executors, administrators, or assigns, I hereby fully and forever release, waive, discharge, and covenant not to sue Tiny Beans Play Cafe, its owners, officers, employees, agents, contractors, volunteers, or representatives (collectively, “Released Parties”) for any and all claims, demands, losses, liabilities, damages, or causes of action of any kind whatsoever, whether known or unknown, suspected or unsuspected, arising from or in any way related to my Child(ren)’s participation or use of the play floor or any activities at Tiny Beans Play Cafe, including, without limitation, claims arising from the negligence, gross negligence, or other acts or omissions of the Released Parties or other participants.
Indemnification and Hold Harmless: I agree to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, suits, liabilities, damages, losses, costs, and expenses (including attorney’s fees) arising out of or related to my Child(ren)’s participation, including but not limited to claims made by third parties.
Medical Authorization: I authorize Tiny Beans Play Cafe and its staff to obtain medical treatment for my Child(ren) in the event of an emergency. I acknowledge that I am solely responsible for any medical expenses incurred and that Released Parties are not responsible for any medical care.
Health and Safety Compliance: I represent that my Child(ren) is/are in good health and physically capable of participating. I agree not to allow my Child(ren) to participate if they are ill, have a communicable disease, or display symptoms of illness. I will immediately notify Tiny Beans Play Cafe if my Child(ren)’s health status changes prior to or during participation.
Rules and Conduct: I agree to ensure that my Child(ren) complies with all rules, guidelines, and instructions provided by Tiny Beans Play Cafe staff. I understand that failure to comply may result in immediate removal from the facility without refund.
Photographs and Media: I consent to the taking and use of photographs, videos, and other media of my Child(ren) for promotional purposes unless I provide written notice otherwise prior to participation.
Severability: I agree that if any provision of this Waiver is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.
Governing Law and Jurisdiction: This Waiver shall be governed by, construed, and enforced in accordance with the laws of the Commonwealth of Virginia. Any disputes arising from this Waiver shall be resolved exclusively in the courts of Virginia.
Duration: This Waiver remains in full force and effect for one (1) year from the date of signature below unless revoked in writing by the undersigned.
Acknowledgment of Understanding: I HAVE READ THIS WAIVER, FULLY UNDERSTAND THAT I AM GIVING UP LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE, AND SIGN IT VOLUNTARILY. I EXPRESSLY ACKNOWLEDGE THAT THIS WAIVER IS INTENDED TO BE AS BROAD AND INCLUSIVE AS PERMITTED BY VIRGINIA LAW.
